What are the prohibited activities for property located adjacent to public infrastructure?

Having a building or real estate adjacent national road or major public infrastructure project comes with high economic potential. However, it also comes with responsibility which the owners must follow according to the law.

What activities are prohibited by law if your construction is located near public infrastructure?

Road infrastructures refer to lands along the roadsides, road construction, bus stop, parking lots, street service station, and recreation areas.

Law on Roads has prohibited some activities which can pose a threat to public infrastructures and road traffic safety as follow:

A. Destruction of infrastructures
-Excavation, drilling, road demolition
-Import vehicles & vehicle accessories
-Encroachment or use of roadsides
-Modification or diversion of roads without permission
-Construction on roadsides that block the drainage system

B. Construction or activities that disrupt traffic safety
-Changing road surfaces to be slippery, sticky, and tilt
-Rewriting, disassembling, removing, or damaging traffic signs, traffic lights, and other public instruction
-Dumping construction debris on the road or drying materials on the road

C. Activities Disturbing traffic
-Hosting ceremonies, fairs, gatherings, street vendors, among others on roads or bridges
-Constructing or placing anything on the roadside that blocks motorists or pedestrian’s vision or pedestrians
-Construction of walls or structures on sidewalks
-Filling land higher than roads without a proper drainage system
-Building roads connecting to public roads without permission

D. All other activities that damage public infrastructure or cause danger to people

Anyone who violates the aforementioned regulations will be warned, or/and suspended the business license, and/or punished with fine of a maximum of KHR10 million, and/or up-to 5-year imprisonment.

All constructions with access roads adjacent to expressways, national or provincial roads are also required to spare distance from the construction to the pavement to a certain extent, depending on the size and type of construction. (Read more)
