Gov’t Approves Comprehensive Environmental and Natural Resources Law to Propel Green Development

In a significant move towards sustainable development, the Cambodian Government has granted approval to the draft law of Environment and Natural Resources. The draft, consisting of 12 chapters and 865 articles, received the endorsement of the Council of Ministers during its plenary session on 28 April 2023.

This comprehensive legislation aims to consolidate and streamline existing laws and regulations related to the environment and natural resources. By aligning the roles and responsibilities of relevant ministries and institutions with the evolving needs of society, this draft code paves the way for seamless execution of functions.

The draft law serves as a complement to and harmonizes with existing legislations, including the Criminal Code, the Civil Code, the Forestry Law, the Fisheries Law, the Law on the Management and Exploitation of Resources, the Land Law, the Law on Tourism, and the Law on the Management of Water Resources. Its primary objective is to propel national development and foster the rule of law, propelling Cambodia towards a new era of green and sustainable growth.

The implementation of this landmark law brings forth several key advantages:

  • Strengthening and enhancing environmental management, protection, conservation, and restoration of natural resources, biodiversity, and ecosystem functions.
  • Establishing strategic objectives for environmental protection and the preservation of natural resources.
  • Empowering ministries, institutions, and communities to actively participate in environmental protection, resource management, and biodiversity conservation.
  • Enhancing the efficiency and effectiveness of managing, protecting, conserving, and restoring natural resources, biodiversity, and cultural heritage to ensure sustainable development and prosperity for future generations.
  • Establishing mechanisms to promote environmental awareness and foster research across all segments of society.

Moreover, the Royal Government has issued directives to the relevant ministries and provincial administrations surrounding the Tonle Sap Lake. The instructions entail conducting thorough studies and examinations to assess the feasibility of constructing a sluice gate in the lake. This endeavor aims to regulate water flow and prevent rapid outflow, while considering the legal, environmental, land-related, and agricultural implications.

The approval of this groundbreaking legislation underscores Cambodia’s commitment to fostering green development and underscores the government’s determination to create an environmentally conscious and sustainable future.
