MoE Issues Guidelines on How to Address Impact Resettlement for Involuntary Cases

The Ministry of Environment (MoE) has established new guidelines for private developers on how to deal with resettlement for involuntary cases.

The new guidelines were announced according to the official workshop held in late July.

According to the 6-page guidelines, resettlement applies to people who may face the risk of leaving their homes, and/or involuntarily told to leave land or assets due to private development projects.

The affected people can claim compensation through dispute resolution mechanisms both outside and inside the court system. Dispute resolution outside the court system ranges from the village, commune-Sangkat levels to the National Authority for Land Dispute Resolution.

The guidelines added that there are complicated detailed procedures on how to deal with involuntary cases, including but not limited to providing full compensation for affected land or property, providing new land plot or other property to replace the affected one, or providing enough money to buy equivalent land or property in a similar area.
