Land Ministry Issues New Guidelines to Tighten State Land Demarcation, Ownership Transfers, and Leasing

The Ministry of Land Management, Urban Planning, and Construction issued four new guidelines on 18 January tightening the procedures for state land demarcation, ownership transfers, and leasing.

The introduction of these new policies is to avoid continuous issues such as the transferring or leasing state land to the private sector without verification from the cadastral administration, non-transparent land measuring and demarcating, and duplicate ownership, among other land disputes.

The four guidelines comprise:

1. All land measurements/demarcation shall be carried out and verified by the Cadastral Administration, which is the only competent body in measuring the demarcation of land, according to Articles 229 and 235 of the Land Law.

2. The Capital and Provincial Administration shall give the tasks to the Capital and Provincial Departments of Land Management, Urban Planning, Construction, and Cadastral to measure and verify land based on the cadastral database system.

3. All land measuring data with the purpose of providing ownership or lease state land to the private sector must be submitted to the General Department of Cadastral and Geography for review and verification first. This General Department is in charge of all cadastral database nationwide.

4. Before transferring ownership or leasing state land to the private sector, the relevant parties must first register the land and issue a private state land title.
