Understanding Legal Duties of Solid Waste Management for Different Types of Property

The government, especially the Phnom Penh Municipality, has been recently strengthening solid waste management, as improper waste control can cause issues such as floods and damage the beauty of the city.

According to Sub-Decree No. 113 on Urban Solid Waste Management, improper solid waste management is subjected to up to 2 million riels in fine. The same sub-decree also determines the duty for a different type of property as follow:

1) General owners/users of houses, condos, apartments, and other high-rise buildings shall pack their trashes in packages or bins and store them within the premises of the properties. Trashes are allowed to be taken out only during the specific time of day set by the authority.

2) Owners/managers of markets, business enterprises, companies, factories, handicraft centres, entertainment centres, among others must arrange proper bins in the location or premises for their trashes.

3) Contractors for construction sites must be responsible for solid waste at the site by collecting and transporting them to the landfill themselves or using outsourcing waste collection services.

4) Citizens organizing any events in public areas must responsible for paying, cleaning, collecting, and transporting their waste to the local waste collection service centre.

4) For hazardous waste, the owners must manage them under consultation with the Municipality, District, or Khan Administration.
